CONDITIONS OF ENTRY
Sony Centre WA PS3 Promotion
1. Information on how to enter and prize forms part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each Entrant.
2. Any costs associated with accessing the website remain the responsibility of each entrant and are dependent on the internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
3. Entry is free and open to individuals who (i) are residents of Western Australia aged 18 years or older; (ii) are not employees of the Promoter or any of its related corporations or any of its agencies associated with this offer; and (iii) are not a spouse, defacto spouse, parent, or natural or adopted child or sibling of such an employee.
4. To enter the promotion:
a. Eligible entrants must subscribe to Sony Centre WA as set out in the manner required on the Sony Centre WA website at
www.sonycentres.com.au/Home/Register-for-updates.aspx and remain registered for the duration of the promotion. Eligible entrants who meet these requirements will automatically receive one (1) entry into the promotion.
b. Eligible Entrants must provide all the requested mandatory details, including their title, first name, surname, current and valid email address. Eligible Entrants will also need to tick a ‘check-box’ to confirm that they are over 18 years of age and have read and accept these Conditions of Entry, and Eligible Entrants must also choose to tick a ‘check-box’ to opt-in to receiving future marketing material from the Promoter and its promotional partners in accordance with Condition 27.
c. Each eligible entrant can only subscribe once.
5. Promotion commences at 12:01am (AWST) on 30.7.10 and closes at 11:59pm (AWST) on 31.08.10(Promotional Period). The prize draw will take place on 03.09.10 at 1:00pm (AEST) at Sony Australia, 33-39 Talavera Road, NORTH RYDE, NSW, 2113. The winner will be notified by telephone and email and their first initial, surname and postcode will be published on http://www.sonycentres.com.au no later than 10/09/2010 for a period of at least 1 month. All reasonable steps to notify the winner of the results of draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
6. Prize:
a. The first (1) eligible entry randomly drawn from all eligible entries received will win one (1) PLAYSTATION® 3 120GB CONSOLE (model CECH-2002A) per eligible claim received and validated by the Promoter in accordance with these Conditions of Entry, valued at RRP$499.95.95 (including GST).
b. Prize value is the Recommended Retail Price as at 23.7.10. The total prize pool is $499.95 (including GST).
7. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensibleentries will be deemed invalid. Entries must be received in accordance with the timeframes outlined above, otherwise the entry will be deemed invalid. Claims will be deemed to be accepted at the time of receipt and not at the time of transmission. The Promoter accepts no responsibility for late, lost or misdirected entries.
8. The Prize is not transferable or exchangeable and cannot be taken as cash. The prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value.
9. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
10. The Prize will be delivered to winning entrant within 28 days of the end of the Promotional Period. The Prize will be delivered to Australian addresses only.
11. In the event of a winning entry not being verified in accordance with these Conditions, the Promoter reserves the right to conduct such further draws at 1.00pm (AEST) on 03.12.10 at Sony Australia Limited, 33 – 39 Talavera Road, NSW, 2113 as are necessary to distribute the prize. All Eligible Entrants with non-winning entries will be automatically entered into this second chance draw. In the event of any winners, they will be notified by email within 5 working days of the draw and their names and state/territory of residence will be published on www.sonycentres.com.au by 13/12/10.
12. Entrants can only enter in their own name. The Promoter reserves the right to request all entrants to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm each entrant's identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry has not been verified or validated to the Promoter's satisfaction within the time requested, that entrant's entry will become invalid.
13. The prize will only be awarded following any entrant validation and verification that the Promoter requires in its sole discretion.
14. If the prize becomes unavailable for any reason beyond the Promoter's reasonable control, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities, where required.
15. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred by any Eligible Entrant connected with this offer, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from or contributed to by negligence of a Relevant Party; (iii) any liability for personal injury or death. The Promoter will not be liable for any damage in transit to the prize.
16. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
17. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
18. The use of any automated entry software or any other mechanical or electronic means that allows a entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
19. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
20. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
21. The Promoter may use the information for future promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. If an entrant wishes to access, update or correct any personal information, they should contact the Promoter at the address below.
22. The information Eligible Entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. By entering the Promotion, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products, including contacting the entrant via electronic messaging.
